General
This website is owned and operated by Elite Liqueurs Limited (“Elite Liqueurs”) (“us” or “we”). By using the website, you represent that you have read, understood and accepted these Terms, and agree to be bound by them. Your access to and use of the website is subject to these Terms.
Elite Liqueurs reserves the right to amend the website from time to time. Unless stated
otherwise, any change takes effect immediately. You are responsible for ensuring you are familiar with the latest Terms. By continuing to access and use the website, you agree to be bound by the changed Terms.
This website is an online store website where you can browse, select and order products as advertised by Elite Liqueurs. When you buy products using this website, you enter into a contract with Elite Liqueurs for the sale and supply of the products (Order Terms and
Conditions).
These Terms should be read in conjunction with our Privacy Policy and the Order Terms and Conditions. In the event of a conflict between these Terms and the Order Terms and Conditions, these Term will prevail.
You must be 18 years of age or older to access and use the website.

Definitions In these Terms:
Loss includes loss of profits, savings, revenue or data, and any other claim, damage, loss, liability and cost Supplier means Schladerer Terms means these terms and conditions titled Website Terms and Conditions We, us or our means Elite Liqueurs Limited Your Obligations You must provide true, current and complete information in your dealings with us (including when setting up an account) and must promptly update that information as required so that the information remains true, current and complete.
You warrant that:
a. the person receiving the products at the delivery address is authorised by you to do so; 

b. you have and will comply with all relevant laws relating to your use of the website and
your placement of any order through the website.
You must:
a. not act in a way, or use or introduce anything (including any virus, worm, or other similar
feature) that in any way compromises, or may compromise, the website, or otherwise
attempt to damage or interfere with the website;
b. make fraudulent or speculative enquiries, purchases or requests through the website;
and
c. use another person’s details without their permission or impersonate another person
when using the website. You indemnify us against all Loss we suffer or incur as a direct or indirect result of your failure to
comply with these Terms.
Acceptance or rejection of an order
Each order placed for products through the website, that we accept, results in a binding agreement between you and Elite liqueurs and is governed by the Order Terms and Conditions.
a. We reserve the right to accept or reject your order at our sole discretion, including if you have breached these Terms, the Order Terms and Conditions or if the requested
product is not available or if there is an error in the price or the product description
posted on the website or in your order.
b. If we reject an order placed through the website, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.
Restricted Products All orders that we accept for liquor products are processed and distributed by Elite Liqueurs.
You:
a. acknowledge that it is against the law to sell or supply alcohol or obtain alcohol
products on behalf of, a person under the age of 18 years; and
b. warrant that you are not obtaining alcohol (including liquor products) on behalf of a
person under the age of 18 years.
Delivery of Products
Elite Liqueurs is responsible for complying with their Off Licence Conditions pursuant to the
Sale and Supply of Alcohol Act 2012 (including any Regulations) including taking reasonable steps to verify that the prospective buyer and prospective receiver are over the age of 18 years
of age.

Intellectual property
We (and our Supplier) own all proprietary and intellectual property rights in all material relating
to the website and its content and is protected by New Zealand and international law. Nothing
in these terms and conditions shall constitute any licence of intellectual property rights.
You must not use any of our intellectual property or any third-party intellectual property
(including our Supplier) without the relevant party’s prior written consent.
Disclaimers
To the extent permitted by law, we and our Supplier have no liability or responsibility to you or
any other person for any Loss in connection with:
a. the website being unavailable (in whole or in part) or performing slowly;
b. any error in, or omission from, any information made available through the website;
c. any exposure to viruses or other forms of interference which may damage your
computer system or expose you to fraud when you access or use the website.
d. the website may contain links to external websites that are not operated by us. These
links are provided for your convenience only and we make no representations or
warranties, or have any responsibility or liability for those websites.
You are responsible for ensuring that your access to and use of the website is not illegal or
prohibited and for your own compliance with New Zealand Law.
Liability
To the maximum extent permitted by law:
a. you access and use the website at your own risk; and
b. we are not liable or responsible to you or any other person for any Loss under or in
connection with these Terms, the website, or your access and use of (or inability to
access or use) the website.
Except to the extent permitted by law, nothing in these Terms has the effect of contracting out of
the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that
cannot be excluded.
Privacy policy
When you provide personal information to us, we will comply with the New Zealand Privacy Act
2020. These Terms should be read in conjunction with our Privacy Policy.
Suspension or Termination
Without prejudice to any other right or remedy available to us, if we consider that you have breached these Terms or we otherwise consider it appropriate, we may immediately, and without notice, suspend or terminate your access to the website (or any part of it). On suspension or termination, you must immediately cease using the website and must not attempt to gain further access.

General
These Terms, and any dispute relating to these Terms or the website, are governed by and must be interpreted in accordance with the laws of New Zealand.
If any part or provision of these Terms is or becomes illegal, unenforceable, or invalid, the remainder of these Terms will be binding on you.
These Terms set out everything agreed by the parties relating to your use of the website. The parties have not relied on any representation, warranty or agreement relating to the website that is not expressly set out in the Terms.

 

 

Order Terms and Conditions
General

Your access to and use of the website is subject to these Terms. These Terms should be read in conjunction with our Privacy Policy, and Website Terms and Conditions.
This website is an online store website where you can browse, select and order products as advertised by Elite Liqueurs. When you submit an order for products on the website, you are offering to purchase the products from us and are agreeing to be bound by these terms and conditions (Order Terms and Conditions).
We accept no liability for any loss resulting from any such errors or from your use of, access to or downloading of any material from the website.
We have no liability in respect of any products you may purchase using this website.

Placing an order for Products
Any order placed through this website for a product is an offer by you to purchase the particular product(s) for the price (including the delivery and other charges) at the time you place the order. We may ask you to provide additional details or require you to confirm your details to enable us to process any orders placed through the website.
You agree to provide us with current, complete and accurate details when asked to do so.
Acceptance or rejection of an order
We reserve the right to accept or reject your order for any reason, including if the requested product is not available, if there is an error in the price or the product description posted on the website or in your order.
If we reject an order placed through the website, then we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.
Restricted Products
You:

a. acknowledge that it is against the law to sell or supply alcohol or obtain alcohol
products on behalf of, a person under the age of 18 years; and
b. warrant that you are not obtaining alcohol (including liquor products) on behalf of a
person under the age of 18 years.
Delivery of Products Our products may be purchased at any time on any day, however our chosen courier service will deliver the products you have ordered and will be guided by the following restrictions:
a. products will not be delivered on ANZAC day before 1pm or on Christmas, day, Easter Sunday, Matariki and Good Friday
b. products will also not be delivered between the hours of 11pm and 6am on any other
day.
You agree to comply with the following delivery requirements and any other requirements
notified by us at the time of order:
a. You or a nominated person over the age of 18 must be present to accept delivery of your
order and have photographic identification available.
b. If there is no one or no appropriate person (for example, above 18 years old for
Restricted Products) at the delivery address to receive the order the delivery partner will
leave a collection card for you to collect the product at the nearest depot. You will be
required to bring valid ID upon pick up from the depot.
You:
a. acknowledge and agree that any person at the delivery address who receives the
products is authorised by you to receive your order; and
b. will ensure that the person receiving any liquor or other relevant Restricted Products is over the age of 18 years and will present a valid ID at the time of delivery.
You acknowledge that we may record the details of any identification provided in relation to
delivery of products.
Risk and title Risk in the products passes to you on the date and time of delivery to the delivery address. Title to the products passed to you on the later of the date and time of:
(a) payment for those products; and
(b) delivery of those products to the delivery address
Cancelling an order
We may cancel an order (including any orders that we have accepted) without any liability to you for that cancellation at any time if:

a. the requested products in that order are not available; or
b. there is an error in the price, or the product description posted on the website in relation
to the relevant product in that order; or
c. that order has been placed in breach of these terms and conditions.
If we cancel an order, we will provide you with reasonable notice of that cancellation and will not charge you for the cancelled order. Your refund will include including any delivery fee and other fees and charges and will be refunded to your original payment method or through an alternative means.
You may cancel an order (whether it is accepted by us or not), by contacting Elite Liqueurs via
email or phone only if that order has not been processed.
Fees and charges
We will charge you, and you agree to pay, the following fees and charges in relation to an order
that we accept (as applicable):
a. the price of each product that is ordered;
b. the delivery fee; and
c. any other fees and charges set out in these terms and conditions.
All fees and charges identified in these terms and conditions and all prices for the products include GST where applicable and are charged in New Zealand dollars.
The purchase price of each product is shown on the product list on the website at the time you place your order. Prices for our products are subject to change without notice.
Payment methods
You must pay the fees and charges online using the online payment method available.
If we are unable to successfully process your credit card payment for your order that is
accepted by us, then we may notify you and cancel your order.
You authorise us to debit the amount that is payable for an accepted order from your
nominated credit card to pay for the fees and charges.
You must not pay, or attempt to pay, for products through any fraudulent or unlawful means. We will provide you with an invoice at time of delivery for the products in the order.
Out of stocks or missing items in delivery
You acknowledge that a product that you order may be out of stock. If this happens, then we will not be able to provide you with that product. We will contact you to let you know and arrange a refund for the full amount of the out of stock product.

If there is an issue with your delivery, you must make Elite Liqueurs aware that items are missing within 7 days of delivery. Once we are reasonably satisfied that the item(s) were not
delivered to you, then we will either:
(i) provide you a refund for that item within two business days for the product(s) that
were charged but not delivered to you; or
(ii) arrange for a re-delivery of the missing item at an agreed time.
Returns If you wish to return a product that was provided to you under these Terms and Conditions,
because it is faulty or damaged at the time of delivery, then you may:
a) return that product; or
b) contact the Elite Liqueurs via email address or phone number within 7 days of the
delivery time to make arrangements for that product to be returned or a refund made.
You may be required to provide evidence of the defect in order to help verify the defect. All faulty or damaged product must be returned.
Please choose your products carefully as we do not accept returns or refunds for change of mind. 

Your general obligations
You:
a. must provide us with your date of birth to place an order for alcohol where a relevant
law requires us to obtain or verify your date of birth before we agree to supply that
product to you;
b. agree that we may charge you for all products that we agree to supply to you that have
been ordered; and
c. should check the labels on the products before consumption or use.
Liability
Without excluding, restricting or modifying the rights and remedies to which you may be entitled under the consumer guarantees provisions of the Consumer Guarantees Act 1993 or our liabilities under those provisions:
a. you acknowledge that all products and services delivered to you through the website
are each provided "as is" and that we do not make any warranty or representation as to
the suitability of the website or a product for any purpose;
b. we exclude all other implied terms and warranties, whether statutory or otherwise,
relating to the website or the products; and

c. we will not be liable to you for indirect and consequential loss arising from or connected to these Terms in contract, tort, under any statute or otherwise (including, without limitation, for loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data and any other commercial or economic loss of any kind) unless such loss arises as a result of our own negligence or wilful misconduct. Our liability to you for loss or damage of any kind arising out of this agreement or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute or otherwise.

Changes to these terms and conditions We may change these terms and conditions at any time. We recommend that you read these
terms carefully each time you agree to them during the ordering process.
If you have an order that has been accepted by us, the terms and conditions that will apply to the order are the terms and conditions that applied at the time you placed your order.
General
If any part of a provision of this agreement is void or unenforceable, the remainder of this agreement has full force and effect.
This agreement is governed by the laws of New Zealand.
We will use all reasonable endeavours to ensure, that any information provided by our
suppliers, including in relation to product descriptions or other content of this site, is accurate,
complete, reliable, current or error-free.
No delay, neglect or forbearance in taking enforcement action in relation to any provision of
these terms will be a waiver, or in any way prejudice our rights.
